Regulation and Compliance
EMCC was approved by the EU as a “fully functional joint venture”. Consequently, the approval of the establishment of EMCC with regards to merger control is the competence of the Directorate General of Competition (DG Comp) and not the German competition authorities.
EMCC is located in Germany and has to comply with German laws.
Agreements between EMCC and TSOs have to be notified to and approved by the regulators of the relevant TSO.
